Vacation Rental Agreement
This Vacation Rental Agreement (“Agreement”) sets forth the terms and conditions for the rental of the property located at 429 Cold Brook Road, Bearsville, New York, 12409 (“Property”), owned by Coldbrook Bed and Breakfast (“Owner”), to any guest(s) (“Guest(s)”) renting the property.

The property is rented fully furnished and equipped for short-term vacation use.
2. Rental Terms
Check-in Time: 3:00 PM
Check-out Time: 12:00 PM
Guests must adhere to the designated check-in and check-out times. Early check-ins or late check-outs are subject to prior approval by the Owner and may incur additional charges.
3. Rental Fees and Payment
The following fees apply to all rentals:
Rental Fee: The rental fee is determined based on the duration of stay and any special rates applicable at the time of booking.
Security Deposit: A refundable security deposit of $350.00 is required for all reservations.
Taxes: Applicable local taxes will be added to the rental fee.
4. Payment Terms
A 50% deposit is required to confirm the reservation.
The balance of the rental amount, including any fees and security deposit, must be paid no later than 1 day prior to check-in.
Acceptable payment methods include credit card or bank transfer.
Failure to pay the balance by the due date may result in the cancellation of the reservation.
5. Security Deposit
A refundable security deposit of $350.00 is required for all stays.
The security deposit will be returned to the Guest(s) within 5 days after check-out, provided there is no damage to the property or violation of this Agreement.
Deductions may be made for damages, missing items, or excessive cleaning required beyond normal use.
6. Cancellation Policy
The cancellation policy is as follows:
Cancellation - Any paid amount is non-refundable. Unpaid remaining balances will not be charged.
No-show or early departure: No refund will be provided.
7. Maximum Occupancy
The maximum number of guests permitted at the property is 4 per suite. Overcrowding the property without the Owner’s consent will result in immediate termination of this Agreement and possible eviction without refund.
8. House Rules
All Guest(s) must follow the house rules below:
No smoking inside the property.
No pets allowed unless agreed upon in advance by the Owner.
Pet restrictions: Under no circumstances will dogs over 40 lbs be allowed on the premises.
Pet care requirements: Approved pets, such as small dogs, must not be left uncrated and unattended when the Guest(s) are not in their room. Dogs must be on a leash when on the property.
Pet fees will apply
No parties or events.
Fire pit use: a fire pit is available for guest use, the following rules must be adhered to:
Fires must be attended at all times and fully extinguished after use.
Only designated firewood may be used—no burning of trash or other materials.
Use of the fire pit is not permitted during windy or dry conditions that could pose a fire hazard.
Fire pits must only be used in compliance with local safety regulations.
Quiet hours: from 10:00 PM to 8:00 AM
Any complaints of disturbances or violation of house rules may result in immediate eviction without refund.
9. Use of Property
The property is to be used for residential vacation purposes only.
Guest(s) agree to respect the property and its contents and report any issues to the Owner immediately.
Guest(s) are responsible for maintaining the cleanliness of the property during their stay.
10. Maintenance and Damage
The Owner will make every effort to ensure the property is in good working order.
Any damage caused by Guest(s) beyond normal wear and tear will be the responsibility of the Guest(s) and may be deducted from the security deposit.
Guest(s) must immediately notify the Owner of any damage or maintenance issues.
11. Liability and Indemnity
The Owner is not responsible for any accidents, injuries, or illnesses that occur on the property.
The Guest(s) assume all risks of using the property and agree to release the Owner from any liability for damages, loss, or injury related to their stay.
The Guest(s) agree to indemnify and hold the Owner harmless from any claims, liabilities, or expenses arising from the Guest(s)’ use of the property.
12. Entry and Inspection
The Owner or authorized personnel may enter the property at reasonable times for inspection, maintenance, or emergencies.
The Owner will provide prior notice where possible, except in case of emergencies.
13. Governing Law
This Agreement shall be governed by and construed in accordance with the laws of the state of New York, and any disputes shall be resolved in the courts of New York.
14. Agreement Acceptance
By booking and staying at the Property, the Guest(s) agree to all the terms and conditions set forth in this Vacation Rental Agreement.
